Plaintiff filed this putative class action against Safe Streets on February 12, 2018.
alleging claims under the Fair Labor Standards Act (“FLSA”), various sections of the California Labor Code, and the California Business & Professions Code. One of Anderson’s California Labor Code claims is a Private Attorneys General Act (“PAGA”) claim to recover civil penalties.
In April of 2018, the Court ordered Plaintiff's individual claims to arbitration. Plaintiff successfully arbitrated those claims.
Following the arbitration, the parties returned to the Court and continued litigating the matter. In August of 2021, the parties engaged in a mediation and a Settlement of the remaining claims.
Although the court granted preliminary approval of the Settlement, on December 20, 2022, the Court denied Final Approval of the Settlement.
On March 20, 2023, the Court granted Defendant Leave to File a motion to compel arbitration of Plaintiff's individual PAGA claims and a motion to dismiss the remaining representative action PAGA claims.
On May 16, 2023, the Court granted Defendant's motion to compel arbitration of Plaintiff's individual PAGA claims and stayed the case with respect to Defendant's motion to dismiss the remaining representative action PAGA claims. The parties reached a settlement with respect to Plaintiff's individual PAGA claims and a further settlement with respect to the remaining representative action PAGA claims. There is a Motion pending before the Court with respect to Court approval of the settlement of the representative action PAGA claims.
On November 19, 2024, the Court granted approval of Settlement of the representative action PAGA claims.
