Settled and Closed - Chandler v. First American Title

That Defendants First American Title Company, First American Title Insurance Company and/or First American Financial Corporations (collectively “First American” or “Defendants”) engaged in the following illegal activities: (1) discriminated against Plaintiff on the basis of her age, physical disability, medical condition, and for taking protected leave authorised by the California Family Rights Act (“CFRA”), all in violation of California Government Code section 12940(a) and California Government Code sections 12945.2(a) and (k)(1); (2) retaliated against Plaintiff for taking protective leave under the CFRA in violation of California Government Code section 12940(h) and California Government Code sections 12945.2(a) and (k)(1) and after Plaintiff complained of age discrimination, the failures to accommodate her physical disability and medical condition, and Plaintiff’s need to take leave under the CRFA; (3) failed to take all reasonable steps necessary to prevent discrimination and retaliation from occurring in the workplace in violation of California Government Code section 12940(k); (4) failed to engage in the interactive process and failed to provide a reasonable accommodation due to Plaintiff’s physical disability and medical condition and need for CFRA leave in violation of California Government Code section 12940(k); (5) failed to grant Plaintiff’s request to take leave under the CFRA in that Defendants failed to guarantee Plaintiff reemployment in the same or comparable position upon granting the leave in violation of California Government Code section 12945.2(a); and, (6) wrongfully terminated Plaintiff because of her age, physical disability, medical condition, use of protective leave under the CFRA, and/or in retaliation after Plaintiff complained of age discrimination and failures to accommodate her physical disability, her medical condition, and her taking CFRA leave in violation of California Government Code sections 12940, 12945.2, et seq. and public policy, article I, section 8, of the California Constitution.

The parties were able to reach a settlement with respect to Plaintiff's claims.
