Plaintiff Tawanna Fortson (“Plaintiff”) provided caregiving services to clients of Defendant Care Options Management Plans and Supportive Services, Inc. (“COMPASS” or “Defendant”).
In addition to Plaintiff’s individual claims for discrimination and wrongful termination, Plaintiff also presents a claim on behalf of all similarly situated employees pertaining to her wage statements. Plaintiff alleges that Defendant failed to provide accurate wage statements to its employees as required by California Labor Code sections 226(a)(8). Specifically, Plaintiff alleges that Defendant failed to list the name and address of the employer on the wage statement.
After extensive litigation since 2016, the parties have reached a settlement of both Ms. Fortson's individual claims and the class claims and class notice has been mailed to class members. The Court has granted preliminary approval and the final approval hearing is set to take place in August, 2022. After final approval is granted, the settlement administrator will distribute payments to class members.
