Plaintiff Tawanna Fortson (“Plaintiff”) provided caregiving services to clients of Defendant Care Options Management Plans and Supportive Services, Inc. (“COMPASS” or “Defendant”).
In addition to Plaintiff’s individual claims for discrimination and wrongful termination, Plaintiff also presents a claim on behalf of all similarly situated employees pertaining to her wage statements. Plaintiff alleges that Defendant failed to provide accurate wage statements to its employees as required by California Labor Code sections 226(a)(8). Specifically, Plaintiff alleges that Defendant failed to list the name and address of the employer on the wage statement.
After extensive litigation since 2016, the parties have reached a settlement of both Ms. Fortson's individual claims and the class claims and class notice has been mailed to class members. The Court has granted both preliminary and final approval of the settlement.
The settlement is a tiered payment settlement. The settlement administrator has begun receiving settlement funds from the Defendant and has begun disbursing initial settlement payments. The final settlement payments to class members is scheduled to take place in late July or early August, 2024.
