Settled and Closed - Rypka v. Volume Snacks, Inc.

This action alleges Defendant Volume Snacks, Inc. dba DeRosa Sales ("Defendant"): (1) failed to pay regular and overtime wages as required by California Labor Code sections 510, 558 and 1194; (2) failed to timely pay employees for all wages owed in violation of California Labor Code sections 204 and 204b; (3) failed to maintain and provide accurate wage statements to employees as required by California Labor Code sections 226 and 1174; 4) paid employees less than minimum wage in violation of California Labor Code section 1194; (5) failed to reimburse Plaintiff and those similarly situated for work-related expenses incurred in the discharge of their duties in violation of California Labor Code section 2802 and applicable Industrial Welfare Commission Orders; (6) failed to set forth in writing the method by which commissions were paid to Plaintiff and those similarly situated employees in violation of California Labor Code section 2751; (7) took deductions from commissions owed to Plaintiff and those similarly situated employees in violation of California Labor Code sections 221 and 400-410; and, (8) failed to provide Plaintiff and those similarly situated employees with rest and meal breaks, or pay the employees the additional hour of compensation for the failure to provide compliant meal and rest breaks, in violation of California Labor Code sections 226.7 and 512. Said conduct, in addition to the foregoing, violated each Labor Code section as set forth in California Labor Code section 2699.5.

The parties were able to reach a settlement of all claims.

On December 5, 2017, the Court granted final approval of the Settlement, funds were disbursed and the case is closed.
