On November 27, 2018, Plaintiff Thomas filed a PAGA action entitled Yolanda Thomas v. CVS Health Corporation, et al., Los Angeles Superior Court Case No. 18AVCV00124, alleging one claim for penalties under PAGA.
On January 25, 2019, Plaintiff Cano filed her action, entitled Heather Cano v. CVS Pharmacy, Inc. et al., Los Angeles Superior Court Case No. 19STCV02636, alleging the same single claim for penalties under PAGA.
On April 16, 2019, the Court granted CVS’s motion to consolidate the Thomas and Cano cases. On May 15, 2019, Plaintiffs filed the Complaint, consolidating the Thomas PAGA Action and the Cano PAGA
Action in Los Angeles Superior Court, Consolidated Case No. 18AVCV00120.
After participating in a private mediation and following additional and extensive negotiations, the parties were able to reach a settlement of their claims.
On February 4, 2021, the Court granted approval of the Settlement. Disbursement of settlement funds is anticipated to occur in mid-April, 2021.
The funds were distributed and the case is now closed.
