This is an action for recovery of penalties under the California Labor Code Private Attorneys General Act of 2004 (“PAGA”), Cal. Lab. Code Section 2698, et seq. PAGA Permits an “aggrieved employee” to bring a lawsuit on behalf of himself or herself and other current and former employees to address an employer’s violation of the California Labor Code. Plaintiffs allege Defendant violated California Labor Code Section 1198 and Wage Order 7-2001, Section 14, by failing to provide suitable seats to Plaintiffs and other current and former employees. Plaintiffs seeks penalties on behalf of themselves and other current and former employees of defendant. This is not a class action.

This case has been coordinated in the San Mateo Superior Court under Case No. JCCP 5196.

Plaintiff's claims were tried before the Court in July of 2024. On May 1, 2025, the Court issued a Statement of Decision awarding Plaintiffs $30,000,000. Defendant will appeal.
