Active - Silicani v. Trader Joe's Company

This is an action for recovery of penalties under the California Labor Code Private Attorneys General Act of 2004 (“PAGA”), Cal. Lab. Code Section 2698, et seq. PAGA Permits an “aggrieved employee” to bring a lawsuit on behalf of himself or herself and other current and former employees to address an employer’s violation of the California Labor Code. Defendants here violated California Labor Code Section 1198 and Wage Order 7-2001, Section 14, by failing to provide suitable seats to plaintiff and other current and former employees. Plaintiff seeks penalties on behalf of herself and other current and former employees of defendants as provided herein. This is not a class action.

This case has been coordinated with the cases listed below and is now proceeding in the San Mateo Superior Court under Case No. JCCP 5196.

The coordinated cases are:

1. Silicani et al. v. Trader Joe’s Company (“Silicani”), San Mateo County Superior Court Case No. 20CIV00668, filed on January 31, 2020;
2. Bartlett et al. v. Trader Joe’s Company (“Bartlett I”), San Francisco County Superior Court Case No. CGC-20-588293, filed on December 4, 2020; and
3. Bartlett et al. v. Trader Joe’s Company (“Bartlett II”) (together with Bartlett I, “the Bartlett cases”), San Francisco County Superior Court Case No. CGC-21-589761, filed on February 16, 2021.
